TERMS AND CONDITIONS

These Terms & Conditions apply to all purchases made through sofiayorke.eu. By placing an order, you confirm you have read, understood, and accepted these terms.

2. PRODUCTS & AVAILABILITY 

All products are handmade, produced in micro-batches, or one-of-a-kind.
Once an item is sold out, it may not return to stock.

I reserve the right to modify or discontinue products, pricing, or availability at any time.


3. DIGITAL PRODUCTS & ACCESS 

Digital products include e-books, poetry collections, short stories, and other downloadable content.

Access is delivered immediately after successful payment via download link or email.

The customer is responsible for ensuring their device supports the file format.

Prices on sofiayorke.eu include VAT. Fourthwall displays VAT at checkout.


4. DIGITAL PRODUCTS — NO REFUNDS 

All digital purchases are final sale.

By purchasing, you acknowledge that:

You are buying a non-refundable digital product.

You waive your right to withdrawal under Article 16(m) of the EU Consumer Rights Directive.

Once accessed or downloaded, the transaction is complete.


No refunds, returns, exchanges, or cancellations are available on digital products.


5. UNAUTHORISED TRANSACTIONS & PAYMENT DISPUTES 

If you believe a payment was unauthorized, contact me immediately.

By completing a purchase, you agree:

Not to file chargebacks for non-refundable digital content.

That any dispute may result in submission of proof of your agreement to the payment processor.

That fraudulent disputes may result in restricted access to future purchases.


I reserve the right to refuse future sales to customers who abuse or attempt to abuse the refund policy.


6. INTELLECTUAL PROPERTY & USAGE RIGHTS 

All digital and physical content is the intellectual property of Sofia Yorke.

You receive a non-exclusive, non-transferable license for personal use only.

You may not:

Share, copy, distribute, or resell content

Claim authorship

Modify or republish

Use it commercially without written permission


Violations may result in legal action.


7. ORDER PROCESSING & DISPATCH 

Orders are processed within 1–3 business days.
During peak periods (e.g., December andbother holidays), processing times may be longer.

You will receive a dispatch email with Track & Trace information once your order has shipped.


8. MINIMUM ORDER VALUE 

  • Due to platform limitations, a minimum order amount of €10 is required.
    This applies to the entire webshop and does not include shipping fees.

9. SHIPPING POLICY 

9.1 General

All physical items ship from the Netherlands via PostNL or another carrier at my discretion.
Shipping costs depend on weight, destination, and shipping method, and are shown at checkout.

Delivery times are estimates and may be affected by customs, weather, strikes, or other events beyond my control.


9.2 Incorrect or Incomplete Addresses

Orders ship to the address entered at checkout.

If the address is:

incorrect

incomplete

outdated

or entered with errors


then:

the order cannot be refunded

the order cannot be replaced

the order cannot be resent


If the parcel returns due to an address error, the customer must place a new order.


9.3 Failure to Collect / Refused Delivery

If a parcel is returned because it was not collected or delivery was refused:

no refund will be issued

reshipping is not possible


A new order must be placed.



9.4 Uninsured Shipping

Includes Track & Trace only.
No compensation for:

loss

damage

delay


By selecting uninsured shipping, you accept full responsibility once the parcel is handed to PostNL.

9.5 Insured Shipping

Includes Track & Trace and insurance coverage.

Dutch orders ship aangetekend (registered).

International orders ship insured via PostNL.


If a parcel is lost or damaged, reimbursement is possible only after PostNL approves the claim.
PostNL investigations can take several weeks.

Insured shipping is strongly recommended for orders above €50.


9.6 Customs & Import Fees

For shipments outside the Netherlands:

  • customs duties
  • handling fees
  • taxes
  • and import charges

are the responsibility of the customer.

Customs delays do not qualify for refunds.

Uninsured or insured available.
Estimated delivery: 1–3 business days after dispatch.*


EU Countries (Uninsured or Insured)

Austria, Belgium, Bulgaria, Croatia, Cyprus, Czechia, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden.


Europe — Non-EU (Uninsured or Insured)

Andorra, Iceland, Liechtenstein, Monaco, Norway, San Marino, Switzerland, Vatican City, United Kingdom.
Estimated delivery: usually 3–10 business days.*


Europe — Insured-Only Destinations

Albania, Bosnia & Herzegovina, Kosovo, Moldova, Montenegro, North Macedonia, Serbia.
Estimated delivery: 2–4 weeks.*


International Destinations (Outside Europe)

Australia, Canada, Hong Kong, Japan, New Zealand, Singapore, South Korea, United States.
Estimated delivery: 2–5 weeks.*

Orders to countries not listed are not available.


11. PACKAGING 

Eco-conscious packaging is used where possible, including recycled tissue paper and reused filler materials.

All items in an order ship together, except when ordering a Yorke Box alongside other items due to weight limitations.


12. RETURNS & REFUNDS 

12.1 General

Returns are accepted only in accordance with EU law (EU customers only). 
International orders are final sale.

The return address is provided only after a return request is approved.

Returns without prior approval will not be considered accepted and will not be refunded.


12.2 EU Right of Withdrawal (EU Customers Only)

EU customers may withdraw within 14 days of receiving their order.

To qualify, items must be:

unused

unopened and sealed (if applicable)

in original condition

safely packaged


Return shipping is the customer’s responsibility.
Original shipping fees are not refunded.

If a return parcel is lost and no tracking is provided, no refund can be issued.

 


12.3 Hygiene-Sensitive Products

Soaps, candles, and other hygiene-sensitive products are sealed for safety.

These items cannot be returned once the hygiene seal is broken

(e.g., sticker broken, lid opened, wrapping removed).

Unopened items may be returned within the EU withdrawal period.


12.4 Yorke Boxes (Limited Edition Bundles)

Yorke Boxes are sold as one single curated product.

Because they are limited, handmade, and include hygiene items:

partial returns are NOT accepted

the entire box must be returned

if any hygiene item is opened, unsealed, or used,
the entire box becomes non-returnable


International Yorke Box orders are final sale.


12.5 International Orders

For all destinations outside the EU:

All sales are FINAL.

No returns, no refunds, no reshipments.

Only insured parcels may qualify for a carrier-approved damage claim.
Uninsured parcels cannot be refunded or replaced.


13. DAMAGED OR DEFECTIVE ITEMS 

If your order arrives damaged, contact me within 48 hours with clear photos of:

Insured Shipments

Claims must be handled through PostNL.
Refunds are only possible if the carrier approves the claim.

Uninsured Shipments

Cannot be refunded or replaced.


14. LIABILITY 

I am not responsible for:

postal or customs delays

incorrect address entry

uncollected or refused parcels

allergic reactions

misuse of products

minor variations in handmade items

natural differences in scent, colour, or texture


15. GOVERNING LAW 

These Terms & Conditions are governed by the laws of the Netherlands.
Any disputes will be handled by the Dutch courts.


16. CHANGES TO TERMS 

I reserve the right to update these Terms & Conditions at any time.

Changes take effect immediately upon posting.
